1. Overview

This website, gmdyco.com (the "Site"), is operated by GMDY LIMITED LIABILITY COMPANY ("GMDY," "we," "us," or "our"). By visiting the Site, creating an account, signing up for emails or texts, or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Shipping Policy, and Return & Exchange Policy, which are part of these Terms. If you don't agree, please don't use the Site.

2. Using the Site

You must be at least the age of majority where you live, or have the consent of a parent or guardian, to make a purchase. You agree to give us accurate, current information when you place an order or create an account, and you're responsible for keeping your account login secure. You may not use the Site for any unlawful purpose, to interfere with its operation or security, to scrape or copy its content in bulk, or to submit false, misleading, or abusive content.

3. Products

We do our best to show our products accurately, but colors and details can look different depending on your screen, and we can't guarantee that every image is an exact match. Product descriptions, sizing information, and availability may change at any time. We may limit quantities, discontinue products, or refuse any order at our discretion.

Products marked "Coming soon," and any waitlist or "Notify me" sign-up, are not a reservation or a guarantee that the product or a particular size will be available. Release timing is an estimate and may change.

4. Pricing and Payment

All prices are in U.S. dollars and may change without notice. Taxes and shipping charges are calculated at checkout. If a product is listed at the wrong price or with wrong information because of a typo or system error, we may cancel any order for that product, even after you get an order confirmation, and we'll refund anything you were charged. Payments are processed by our third-party payment providers. By submitting payment, you confirm that you're authorized to use that payment method.

5. Orders

Your order confirmation email means we received your order. It doesn't mean we've accepted it. We may cancel or limit an order, for example for suspected fraud, pricing errors, or limited stock, and we'll refund you in full if we do. Once an order has been processed, we can't change it.

6. Shipping, Exchanges, and Returns

We currently ship within the United States only. Shipping times, costs, and delivery details are in our Shipping Policy. Size exchanges are available within 14 days of delivery, and items that arrive damaged, defective, or incorrect will be replaced or refunded, as described in our Return & Exchange Policy. All other sales are final.

7. Reviews and Content You Submit

If you submit a review, photo, comment, or other content, you confirm that it's honest, reflects your own experience, and doesn't violate anyone's rights. You give us a non-exclusive, royalty-free, worldwide license to use, display, and share that content in connection with GMDY. We may remove content at our discretion. Reviews from anyone connected to GMDY will be identified as such.

8. Intellectual Property

The GMDY name, logo, designs, photos, text, and other content on the Site belong to GMDY or our licensors and are protected by law. You may not copy, reproduce, or use them without our written permission. University names, logos, colors, and other marks are the property of their respective institutions. Nothing on the Site gives you any right to use them.

9. Third-Party Services and Links

The Site may include tools, services, or links provided by third parties, such as payment processors, shipping carriers, review platforms, and social media. We don't control and aren't responsible for third-party sites or services. Your use of them is at your own risk and subject to their terms.

10. Disclaimers

The Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except where those warranties can't be disclaimed under applicable law. We don't guarantee that the Site will be uninterrupted, secure, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, GMDY and its owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to a product or order is limited to the amount you paid for that product or order.

12. Indemnification

You agree to indemnify and hold harmless GMDY and its owners, employees, and partners from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your breach of these Terms or your misuse of the Site.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any dispute relating to these Terms, the Site, or our products will be brought only in the state or federal courts located in Denton County, Texas, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when they're posted on this page, and the "Last updated" date above will change. Continuing to use the Site after an update means you accept the revised Terms.

15. Mobile Messaging Terms

The GMDY mobile message service (the "Service") is operated by GMDY LIMITED LIABILITY COMPANY. By consenting to GMDY's SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of GMDY through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts). Promotional messages may include promotions, specials, new releases, and other marketing offers (e.g., cart reminders).

Consent is not a condition of any purchase, and your participation is completely voluntary. We do not charge for the Service, but message and data rates may apply. Message frequency varies. Check your mobile plan and contact your wireless provider for details.

You may opt out at any time. Text STOP to (855) 768-5402 or click the unsubscribe link (where available) in any text message. We may change the phone number we use to operate the Service and will notify you if we do. Messages sent to a number we no longer use, including STOP or HELP requests, may not be received. Wireless carriers are not liable for delayed or undelivered messages. To the extent permitted by law, we are not liable for failed, delayed, or misdirected delivery of any message, any errors in a message, or any action you take in reliance on a message.
